Within the space of just over four months in the Spring and Summer of 2025 the Supreme Court has handed down judgment in a trilogy of cases involving fiduciary law and remedies. In each case the Supreme Court endorsed equitable orthodoxy and provided much needed clarity to areas of great commercial significance, but it has also left significant questions unanswered and created new areas of uncertainty. This presentation will consider the significance of these decisions as regards when fiduciary duties will be recognised, how fiduciary law relates to the tort of bribery, the nature of accountability for profits, the nature of the constructive trust and remedies for dishonestly assisting a breach of trust.
